SMS Terms of Service

These SMS Terms & Conditions ("SMS Terms") govern the SummitCove Guest Messaging text message program (the "Program") operated by Summit Cove LLC, doing business as SummitCove Vacation Lodging ("SummitCove," "we," "us," or "our"). By providing your mobile telephone number to us and agreeing to receive text messages, you accept these SMS Terms. These SMS Terms are in addition to, and do not replace, any other agreement between you and SummitCove, including our rental agreement and website terms.

1. Program description

The Program sends non-marketing, transactional customer care text messages to guests who have an existing or recently completed reservation with SummitCove. Messages relate directly to your stay and include:

• Pre-arrival and check-in messages — property address and directions, door or lock codes, parking details, check-in time and instructions, and arrival-day reminders.
• In-stay customer service — responses to questions you send us, maintenance and housekeeping coordination, guest services follow-up, and time-sensitive notices affecting your unit or the property (for example, utility interruptions, weather, or road conditions).
• Post-stay messages — checkout reminders, lost-and-found follow-up, and a request to review your stay.

We do not send promotional or advertising text messages through this Program.

2. How you enroll (opt-in)

You are enrolled in the Program only if you provide your mobile telephone number to SummitCove in connection with a reservation and affirmatively consent to receive text messages — for example, by checking the SMS consent box during online booking or in the SummitCove Guest Portal, by giving verbal consent to a SummitCove reservations or guest services agent, or by texting us first at our published Program number.

Consent to receive text messages is not a condition of booking, renting, or purchasing any SummitCove property, good, or service. Only the guest of record or an authorized member of the reservation party may enroll a mobile number. You represent that you are the subscriber or customary user of the mobile number you provide and that you are at least 18 years of age. The Program is available only to mobile numbers in the United States.

If you change or give up your mobile number, you agree to notify SummitCove promptly so that we do not send messages intended for you to another person.

3. Message frequency

Message frequency varies and depends on your reservation and how often you contact us. Most guests receive approximately 3 to 10 messages per reservation. Additional messages are sent in response to your own messages to us.

4. Message and data rates

Message and data rates may apply. Standard messaging, data, and other charges assessed by your wireless carrier are your responsibility. Check your mobile plan or contact your wireless provider for details.

5. How to stop messages (STOP)

You may cancel at any time. Reply STOP to any message from us. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. After you send one of these keywords, we will send you a single confirmation message and then no further messages will be sent from that Program number.

If you opt out, we may still need to reach you about your reservation by phone or email, and you may continue to receive transactional messages that are legally required or that you separately request. To rejoin the Program, reply START to the Program number or contact SummitCove guest services and provide consent again.

6. How to get help (HELP)

Reply HELP or INFO to any message from us for assistance, and we will reply with our contact information. You may also reach SummitCove guest services at 970-368-7023 or by email at [email protected].

7. Supported carriers and carrier liability

The Program is supported by most major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, and many regional and MVNO carriers. Carrier participation may change without notice, and the Program may not be available on all carriers or on all devices.

Wireless carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and to network availability, and neither SummitCove nor any wireless carrier guarantees that any message will be delivered, delivered on time, or delivered without error. Do not rely on text messaging for emergencies. In an emergency, call 911. For urgent property issues, call SummitCove at 970-368-7023.

8. Privacy

Information you provide in connection with the Program is handled in accordance with our Privacy Policy. SummitCove does not sell, rent, or share mobile telephone numbers, text message opt-in data, or SMS consent with any third party, affiliate, or lead generator for their own marketing or promotional purposes at any time. We share this information only with vendors and subcontractors that help us operate the Program and support your stay (for example, our messaging platform provider and our property management system), and only to the extent necessary for them to perform those services for us.

9. Changes to these SMS Terms

We may modify or cancel the Program or any of its features, and may amend these SMS Terms, at any time without notice. The Program is provided on an "as is" basis. Your continued participation after any change constitutes acceptance of the amended SMS Terms. The effective date above indicates when these SMS Terms were last revised.

10. Governing law

These SMS Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising out of or relating to the Program shall be brought exclusively in the state or federal courts located in Summit County, Colorado, and you consent to the jurisdiction of those courts.
